Further to our recent posting on this subject, see below, we are pleased to report that HMRC has decided not to appeal against the tribunal decision in favour of JD Classic Holdings Ltd. That’s great news for JDCH, of course, but it does mean that no legally binding precedent has been set. Unlike a high court judgement, a tribunal decision does not set a precedent, so it is possible that another importer may have to fight the same battle again.
